A CHARTER ORDINANCE EXEMPTING THE CITY OF GODDARD, KANSAS FROM CERTAIN TERMS AND PROVISIONS OF K.S.A. 14-103 AND 14-204; PROVIDING SUBSTITUTE PROVISIONS ON THE SAME SUBJECTS, RELATING TO THE CONDUCT OF ELECTIONS AND THE TENURE OF ELECTED CITY OFFICIALS; AND REPEALING CHARTER ORDINANCE NUMBER 1.
WHEREAS, the City of Goddard, Kansas has been designated as a city of the second class effective on the 17th day of June, 2010; and
WHEREAS, the City of Goddard, Kansas deems it advisable to exempt itself from certain state statutes generally applicable to cities of the second class; and
WHEREAS, the City of Goddard, Kansas has previously enacted Charter Ordinance No. 1 to exempt itself from certain state statutes generally applicable to cities of the third class concerning the election and tenure of city officials;
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF GODDARD, KANSAS:
The City of Goddard,
Kansas, by virtue of the power vested in it by Article 12, Section 5 of the
Constitution of the State of Kansas, hereby elects to make inapplicable to it
and exempts itself from the provisions of K.S.A. 14-103, and those portions of K.S.A.
14-204 requiring the creation of wards and the election of two council members
from each ward for two year terms at the city election on the first Tuesday in
April of each odd-numbered year.
In exempting itself,
the City of Goddard, Kansas finds that such provisions are applicable to cities
of the second class, but not uniformly applicable to all cities. Therefore, the City of Goddard, Kansas hereby
adopts substitute and additional provisions on the same subject as hereinafter
provided.
There are hereby
established five council member positions which shall be elected at large from
the City of Goddard, Kansas. Three
council member positions shall be filled by election on the first Tuesday in
April in 2011. The remaining two council
member positions shall be filled by election on the first Tuesday in April of
2013. The positions shall be elected for
four (4) year terms. Whenever a vacancy occurs, the governing body shall
appoint an elector from the City of Goddard, Kansas to be council member for
the balance of the unexpired term.
The existing members
of the Goddard City Council shall hold office for their existing terms and
until their successors have been elected and qualified as provided for above.
Charter Ordinance
Number 1 of the City of Goddard, Kansas is hereby repealed.
